SERVICE TERMS & CONDITIONS
These Service Terms & Conditions (“Terms”) apply to services provided by RK Perry Services (“RK Perry,” “we,” “us,” or “our”) to the customer identified on the applicable estimate, quote, work order, service agreement, or invoice (“Client”).
By approving a quote or estimate, signing an agreement, scheduling or authorizing work, or otherwise engaging RK Perry Services to perform services, Client acknowledges and agrees to these Terms.
1. SCOPE OF WORK
RK Perry Services will perform the services described in the Client’s approved estimate, quote, work order, or service agreement (“Scope of Work”).
Only work specifically identified in the Scope of Work is included in the quoted price.
Any additional work requested by the Client or discovered to be necessary during the project may require a revised estimate, change order, or additional authorization and may result in additional charges.
2. ESTIMATES & QUOTES
Unless otherwise stated, estimates and quotes are valid for 30 days from the date issued.
Pricing is based on the information and conditions reasonably observable or provided at the time of the estimate. Pricing may change if the actual conditions, requested scope, material costs, or other project requirements differ from those originally anticipated.
Approval of a quote authorizes RK Perry Services to schedule and perform the work described in that quote.
3. DEPOSITS & PAYMENT
Deposit requirements and payment schedules will be stated on the applicable quote or agreement.
Unless otherwise specified, final payment is due upon completion of the agreed Scope of Work.
Larger projects may require progress payments based on project milestones, materials purchased, or work completed.
Invoices not paid by their stated due date may be subject to applicable late fees and collection costs to the extent permitted by law.
Client is responsible for reviewing invoices and promptly notifying RK Perry Services of any questions or disputed charges.
4. CHANGE ORDERS & ADDITIONAL WORK
Changes to the Scope of Work must be approved by RK Perry Services and may require a written change order or revised quote.
Additional work will be billed separately unless expressly included in the original Scope of Work.
Whenever reasonably possible, RK Perry Services will obtain Client approval before performing additional billable work.
Conditions requiring immediate action to prevent additional property damage or create a safe work environment will be communicated to the Client as soon as reasonably practical.
5. UNFORESEEN & CONCEALED CONDITIONS
Construction, remodeling, repair, and maintenance work can reveal conditions that were not visible or reasonably discoverable before work began.
Examples may include water damage, mold or suspected microbial growth, rot, pest damage, improper previous repairs, structural deficiencies, outdated or noncompliant construction, damaged wiring or plumbing, or other concealed conditions.
Unless specifically included in the Scope of Work, correction of these conditions is not included in the original price.
RK Perry Services may pause affected work and provide recommendations or additional pricing before proceeding.
6. MATERIALS & PRODUCT AVAILABILITY
Material selections, pricing, and availability may change due to supplier inventory, manufacturer changes, discontinuations, delays, or other circumstances outside RK Perry Services’ control.
If a specified material becomes unavailable, RK Perry Services will work with the Client to identify a reasonably comparable alternative. Any resulting difference in material or labor cost will be communicated to the Client.
Special-order or custom materials may require advance payment and may be non-refundable once ordered.
7. CLIENT-PROVIDED MATERIALS
When the Client provides materials, fixtures, appliances, hardware, or other products for installation, the Client is responsible for ensuring that those products are correct, complete, compatible, undamaged, and available when needed.
RK Perry Services is not responsible for manufacturer defects, missing components, incorrect measurements, product failures, or warranty issues involving Client-provided products.
Additional labor caused by defective, incomplete, incorrect, or incompatible Client-provided materials may result in additional charges.
8. PROJECT SCHEDULING & DELAYS
RK Perry Services will make reasonable efforts to meet scheduled dates and estimated project timelines.
Schedules may be affected by weather, material availability, inspections, permitting, subcontractor availability, concealed conditions, Client-requested changes, emergencies, or other circumstances outside RK Perry Services’ reasonable control.
Unless expressly stated in writing, project dates and completion estimates are not guaranteed.
RK Perry Services will communicate material scheduling changes whenever reasonably possible.
9. PROPERTY ACCESS & WORK AREA
Client agrees to provide reasonable access to the property and work areas during scheduled service times.
Client is responsible for removing or protecting personal belongings, valuables, furniture, vehicles, and other items that may interfere with the work unless arrangements have been made with RK Perry Services.
Children and pets should be kept safely away from active work areas, tools, materials, and equipment.
If RK Perry Services cannot reasonably access the work area at the scheduled time, additional trip or rescheduling charges may apply.
10. PERMITS, INSPECTIONS & CODE REQUIREMENTS
Responsibility for permits, inspections, engineering, architectural services, HOA approvals, or similar requirements will be determined by the Scope of Work and applicable law.
Unless specifically included in the quote, permit fees, engineering services, architectural services, HOA fees, and similar third-party costs are not included in the project price.
If previously completed work or existing property conditions must be corrected to satisfy applicable requirements, that corrective work may constitute additional work.
11. SUBCONTRACTORS & SPECIALTY TRADES
RK Perry Services may use qualified subcontractors or specialty trades when appropriate for a project.
RK Perry Services will coordinate work included within its contracted Scope of Work. Work contracted directly by the Client with another provider remains the Client’s responsibility unless otherwise agreed in writing.
12. PROJECT CLEANUP
RK Perry Services will maintain the work area in a reasonably orderly condition and perform reasonable cleanup related to its work.
Construction and remodeling naturally produce dust, debris, noise, and temporary disruption. While reasonable precautions will be taken, complete elimination of construction dust or disruption cannot be guaranteed.
Removal of unusually large amounts of debris, existing materials, abandoned property, hazardous materials, or items outside the contracted Scope of Work may require additional charges.
13. WORKMANSHIP & WARRANTIES
RK Perry Services stands behind the workmanship it provides.
Any workmanship warranty applicable to a particular project will be identified in the applicable quote, agreement, or warranty documentation.
Manufacturer warranties for materials, fixtures, appliances, or equipment are provided by the applicable manufacturer and are subject to that manufacturer’s terms.
Warranty coverage does not apply to normal wear and tear, misuse, neglect, lack of maintenance, damage caused by others, Client-provided materials, manufacturer defects, movement or settlement of the structure, water intrusion from unrelated sources, or modifications performed by another party after RK Perry Services completes its work.
Client should notify RK Perry Services promptly if there is a concern regarding completed workmanship so that RK Perry Services has a reasonable opportunity to inspect and address the issue.
14. EXISTING PROPERTY CONDITIONS
RK Perry Services will take reasonable care while working on the Client ’s property.
RK Perry Services is not responsible for damage resulting from pre-existing deterioration, improperly installed existing materials, concealed defects, inadequate structural support, aging systems, or conditions that could not reasonably have been identified before work began.
15. CANCELLATIONS & RESCHEDULING
Clients should provide as much notice as reasonably possible when requesting cancellation or rescheduling.
Projects involving special-order materials, committed subcontractors, permits, or significant reserved labor may be subject to cancellation charges or non-refundable costs.
Any project-specific cancellation or deposit terms stated in the Client’s quote or agreement will control if they differ from this general provision.
16. MY GUY MAINTENANCE SERVICES
Clients enrolled in a My Guy maintenance plan receive the services specifically identified in their selected plan.
Maintenance visits and inspections are intended to identify visible routine maintenance concerns and provide general home-maintenance assistance. They are not comprehensive property inspections, engineering evaluations, code inspections, environmental inspections, or guarantees that every existing or future property condition will be discovered.
Items identified during a My Guy visit that require repair beyond the labor or services included in the Client’s plan may be separately quoted.
Unused visits, included labor, or plan benefits do not roll over unless specifically stated in the applicable plan.
Any renewal, cancellation, billing frequency, and plan-specific terms will be disclosed when the Client enrolls.
17. PHOTOGRAPHS & PROJECT DOCUMENTATION
RK Perry Services may photograph work areas before, during, and after service for project documentation, quality control, estimating, warranty, and recordkeeping purposes.
Any use of identifiable Client information or project photographs for advertising or marketing will be handled in accordance with any permissions obtained from the Client and applicable law.
18. THIRD-PARTY SERVICES
RK Perry Services is not responsible for delays, defects, failures, or other issues caused solely by manufacturers, suppliers, utilities, inspectors, permitting authorities, Client-selected vendors, or other independent third parties outside RK Perry Services’ reasonable control.
19. LIMITATION OF RESPONSIBILITY
To the extent permitted by applicable law, RK Perry Services will not be responsible for indirect, incidental, or consequential damages arising from circumstances outside the contracted Scope of Work or from conditions not caused by RK Perry Services.
Nothing in these Terms is intended to waive or limit any right or responsibility that cannot legally be waived or limited.
20. DISPUTES & OPPORTUNITY TO CORRECT
If the Client has a concern regarding RK Perry Services’ work, the Client agrees to notify RK Perry Services promptly and provide a reasonable opportunity to inspect the work and, when appropriate, correct covered workmanship issues before engaging another contractor to perform corrective work.
Nothing in this provision limits rights that cannot be waived under applicable law.
21. ENTIRE AGREEMENT & ORDER OF DOCUMENTS
The Client’s approved quote, applicable change orders, project-specific agreements, and these Terms collectively form the agreement between RK Perry Services and the Client for the applicable services.
If a project-specific written agreement expressly conflicts with these general Terms, the project-specific agreement will control with respect to that project.
No verbal statement modifies the Scope of Work, price, or these Terms unless confirmed in writing by RK Perry Services.
22. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
23. ACCEPTANCE
By approving a quote, signing an agreement, authorizing work, or purchasing services from RK Perry Services, Client acknowledges that they have had an opportunity to review these Service Terms & Conditions and agrees to be bound by them.
